U.S. Supreme Court Unanimously Strikes Down Mexican Lawsuit Against American Gun Manufacturers

The U.S. Supreme Court has unanimously voted to throw out a lawsuit the Mexican government brought against multiple American firearm manufacturers, including Smith & Wesson, Barrett Firearms, Beretta, Glock, Sturm, Ruger, Interstate Arms, Century Arms, and Colt.

The lawsuit, Estados Unidos Mexicanos v. Smith & Wesson Brands, Inc., et. al., alleged these companies allowed Mexican drug cartels to buy their guns and should be held liable for damages caused by cartel violence, according to a Second Amendment Foundation press release. First filed in 2021 and seeking billions of dollars in damages from these companies, the case was initially dismissed by the district court. Mexico then appealed the decision to the First Circuit Court of Appeals, which reversed the dismissal, sending the case to the U.S. Supreme Court. 

On June 5, the Supreme Court voted 9-0 to throw the case out, citing the Protection of Lawful Commerce in Arms Act (PLCAA), which “bars certain lawsuits against manufacturers and sellers of firearms,” preventing these cases from being brought to any federal or state court. The law states that firearm manufacturers and sellers are not liable for “criminal or unlawful misuse” of their product by third parties, unless they knowingly violate state or federal laws. 

Gun manufacturers and Second Amendment advocates alike have come out in strong support of the Supreme Court's decision. 

“Today’s unanimous Supreme Court decision shutting down this ridiculous lawsuit against our company represents not only a big win for Smith & Wesson, but our industry, American sovereignty and, most importantly, every American who wishes to exercise his or her Second Amendment rights,” Smith & Wesson CEO Mark Smith said in a statement. “Although the Supreme Court reached the correct decision, it’s frankly a shame that it was allowed to continue in the first place, as the District Court appropriately dismissed the case in 2022, and it was then reactivated on appeal. To all American patriots – you can rest assured that Smith & Wesson will always stand and fight for your Constitutional rights at every turn.”

Louisiana Gov. Signs Law Allowing Non-resident CCW Permits

Louisiana Governor Jeff Landry signed House Bill 407 on June 11, allowing qualifying non-residents to obtain concealed carry permits in the state once the law, Act 273, becomes effective on August 1, 2025.

The bill was brought in response to a lawsuit the Firearms Policy Coalition brought against the state of Louisiana, Mate v. Wescott, which is part of a broader effort to get rid of what they have deemed unconstitutional residency requirements in the state.  

“On behalf of our members, we thank Rep. Ventrella for her leadership on this important issue and Gov. Landry for signing this bill into law,” FPC President Brandon Combs said in a statement. “We are thrilled that Louisiana has made this critical change to improve access to the right to bear arms. We and our members are working to unlock the right to carry throughout the United States, and this bill helps do just that.”
