Colorado Gun Tax Lawsuit & New Firearm Releases: Vedder Nation’s April News Rundown

Lawsuit Filed Against Colorado Gun and Ammo Sales Tax

A new legal challenge has been filed in Colorado over the state’s excise tax on firearms and ammunition. The National Rifle Association of America, Firearms Policy Coalition, Second Amendment Foundation, Colorado State Shooting Association, Magnum Shooting Center, and an NRA member, have joined together to sue the state, arguing that the tax places an unconstitutional burden on the right to keep and bear arms.

The lawsuit targets Colorado’s 6.5% excise tax on all retail gun and ammo sales, which is set to go into effect on April 1, 2025. Although the tax is levied on vendors, the cost is passed down to buyers. The plaintiffs argue that this tax disproportionately impacts law-abiding citizens who are exercising a constitutionally protected right and that the government cannot impose financial barriers on the purchase of firearms.

“Colorado’s new law impermissibly taxes an enumerated constitutional right,” SAF Executive Director Adam Kraut said in a statement. “Not only does the tax lack any basis in our nation’s history and tradition of firearms regulation, it violates Supreme Court precedent that states the exercise of constitutional rights cannot be targeted through taxation. We look forward to vindicating the rights of all Coloradans who are affected by this egregious attempt to chill the exercise of Second Amendment rights.”
